TN Expert Opinion Letter

What is a TN Expert Opinion Letter?

A TN Expert Opinion Letter (EOL) from ProfVal is designed to address the USCIS’ TN requirements related to obtaining a prearranged and temporary full or part-time position in the United States, and the qualifications of the beneficiary applying for this position.

It will help you to provide the necessary evidence by working with a disciplined expert to examine a job position and its duties, creating a report explaining:

  1. How the position qualifies for a TN nonimmigrant classification.

  2. How the position’s duties are so specialized and complex that it requires a NAFTA professional with no less than the equivalent of a university degree, professional certificate, etc.

  3. That you are well-prepared to fill this role.

ProfVal’s TN Expert Opinion Letters provide value to a visa application, as it provides for USCIS agents an honest, independent appraisal of a temporary position, explained in simple terms, to help them more easily understand how the position and the beneficiary meet TN and NAFTA requirements.

Additional details on TN applications

The TN nonimmigrant classification permits qualified Canadian and Mexican citizens to seek temporary entry into the United States to engage in business activities at a professional level. TN visas are uncapped, low cost, indefinitely renewable, and positively impact the U.S. economy, especially in areas with ongoing labor shortages. The visa is aligned with the North American Free Trade Agreement (NAFTA), which created special economic and trade relationships for the United States, Canada, and Mexico.

To apply for the TN visa, a beneficiary must be a citizen of Canada or Mexico, they must have a prearranged and temporary full or part-time job with a U.S. employer, the job must require a NAFTA professional, the job must qualify under a TN nonimmigrant classification, and the beneficiary must meet the qualifications of the position. The USCIS will issue an RFE if an agent questions whether the position meets these requirements or others.

ProfVal's Expert Opinion Letters are used to respond to RFEs and to provide the needed evidence. FOUR reasons why our services are the best available

Some law firms work with us exclusively. Others work with multiple providers, but choose ProfVal when they or their family members are petitioning for a visa.  Here are four reasons why we are better than the alternatives:

  1. Each service is customized and focused on each petitioner's distinct endeavor and contributions. Some providers use boilerplate templates with minimal differentiation between petitioners.

  2. We offer a holistic approach that enables us and experts to understand the broad implications of each endeavor.

  3. Founded by a former tenured professor and associate dean, ProfVal incorporates PhD-level research into our services. It typically takes us over 6 months of research and testing before we introduce a new product publicly.

  4. As a purpose-based company, the goal of ProfVal is to promote equality of opportunity.  In our first year, we donated more than we made.  Through our services, free content (our blog, our sister site), and support of nonprofits, our goal is to promote equality.
