TN Expert Opinion Letters — specialty occupation and beneficiary qualifications.
ProfVal's TN Expert Opinion Letters provide an authoritative, independent evaluation of a position and beneficiary — providing evidence to help establish how a role may qualify under the USMCA for TN nonimmigrant classification, and whether the beneficiary's credentials meet the requirements of that classification.
Written by U.S.-based distinguished experts and adapted to current adjudication standards — including the increasingly scrutinized borderline professions that account for a growing share of TN denials.

TN VISA OVERVIEW
What is the TN visa?
The TN visa — established under the United States–Mexico–Canada Agreement (USMCA), formerly NAFTA — allows Canadian and Mexican citizens to work temporarily in the United States in a designated professional occupation. Unlike the H-1B, TN status does not require employer sponsorship through a lottery and can often be obtained at the port of entry (for Canadian citizens) or through a U.S. consulate (for Mexican citizens).
TN applicants must demonstrate that: (1) the offered position falls within one of the designated USMCA professional categories, (2) the position requires a professional at a minimum degree level, and (3) the beneficiary holds the credentials required for that category. An Expert Opinion Letter can provide evidence to help establish all three.

USMCA PROFESSIONS
Which professions may qualify for TN classification?
The USMCA designates a specific list of professional categories that may qualify for TN status. Below are the most commonly petitioned. See the full profession list on CBP.gov →
Engineers (all types)
Accountants & auditors
Mathematicians
⚠ Management consultants
Medical professionals
University faculty
Graphic / commercial designers
⚠ Scientific technicians
Scientists & researchers
Economists
⚠ Computer systems analyst
And many more
⚠ Borderline professions — higher denial risk: Professions marked above are increasingly scrutinized by CBP and USCIS. Officers frequently question whether the specific duties of the role genuinely align with the USMCA category — for example, whether a "Management Consultant" role involves true consulting or operational management, or whether a "Computer Systems Analyst" role is analytical or primarily developmental. For these professions, a well-prepared Expert Opinion Letter is especially valuable.
WHAT IS COVERED IN A PROFVAL TN VISA?
Three questions every TN EOL must help answer.
A ProfVal TN Expert Opinion Letter addresses the three core USCIS and CBP requirements for TN classification — in clear, accessible language for an officer unfamiliar with the field.
1
Does the position qualify under USMCA?
The expert evaluates the specific duties and responsibilities of the offered role — assessing if and why they may align with a designated USMCA professional category, and whether the position requires a professional at a minimum degree level.
2
Are the duties specialized and complex?
The letter explains if and why the position may require the specialized theoretical and practical knowledge of a USMCA professional — rather than skills that could be performed without degree-level expertise.
3
Is the beneficiary qualified?
The expert evaluates the beneficiary's academic background, credentials, and professional experience — assessing if and why they may meet the USMCA minimum requirements for the relevant category.
