What is a TN Expert Opinion Letter?

A TN Expert Opinion Letter (EOL) from ProfVal is designed to address USCIS TN requirements related to obtaining a prearranged and temporary full or part-time position in the United States, and the qualifications of the beneficiary applying for this position.

The TN nonimmigrant classification permits qualified Canadian and Mexican citizens to seek temporary entry into the United States to engage in business activities at a professional level. TN visas are uncapped, low cost, indefinitely renewable, and positively impact the U.S. economy, especially in areas with ongoing labor shortages. The visa is aligned with the North American Free Trade Agreement (NAFTA), which created special economic and trade relationships for the United States, Canada, and Mexico. 

To apply for the TN visa, a beneficiary must be a citizen of Canada or Mexico, they must have a prearranged and temporary full or part-time job with a U.S. employer, the job must require a NAFTA professional, the job must qualify under a TN nonimmigrant classification, and the beneficiary must meet the qualifications of the position. The USCIS will issue an RFE if an agent questions whether the position meets these requirements or others.
